Terms of Service
These Terms of Service ("Terms") govern your access to and use of the SilkGear website ([www.silkgear.com.au]) and the purchase of any products from our online store. The website is operated by SilkTechs Holding Pty Ltd (ABN 87693640881), trading as SilkGear ("SilkGear", "we", "us" or "our").
By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully. If you do not agree, you should not use our website. Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law (ACL) or other applicable laws.
1. Eligibility and account
To purchase from us, you must be at least 18 years of age and able to enter into a legally binding contract. You may need to create an account to place an order. You are responsible for keeping your account details and password confidential and for all activity under your account. Please notify us immediately of any unauthorised use.
2. Products, pricing and availability
All prices are listed in Australian Dollars (AUD) and, unless stated otherwise, include GST. We make every effort to display product descriptions, images and prices accurately; however, we do not warrant that all content is error-free. Colours and appearance may vary depending on your device.
All orders are subject to product availability. We reserve the right to limit quantities, correct pricing or description errors, and to refuse or cancel an order (including after an order confirmation has been sent) where a product is listed at an incorrect price or is unavailable. If we cancel an order you have paid for, we will provide a full refund of the affected items.
3. Orders and contract formation
When you place an order, you make an offer to purchase the products at the listed price. We will send an order acknowledgement by email; this confirms receipt of your order but does not constitute acceptance. A binding contract is formed only when we dispatch the products to you or otherwise confirm acceptance. We reserve the right to verify orders and may contact you if further information is required.
Pre-orders and Backorders: For items listed as pre-order or backorder, the estimated dispatch dates are provided by our suppliers and are subject to change. We will notify you of any significant delays, and you may request a refund if the revised timeline is no longer suitable.
4. Payment
We accept the payment methods displayed at checkout, which may include credit/debit card, PayPal, Afterpay and other buy-now-pay-later providers. Payment is processed securely by our third-party payment providers; we do not store full card details. You warrant that you are authorised to use the payment method you provide. Title to the products passes to you only when we have received payment in full, and the products have been delivered.
5. Shipping and delivery
We ship within Australia only. Estimated delivery times and shipping costs are displayed at checkout and are estimates only — we are not liable for delays caused by couriers or events outside our control. Risk of loss or damage passes to you on delivery to the address you provide. Please ensure your delivery details are correct, as we are not responsible for orders sent to an incorrectly supplied address.
Click & Collect: For orders selected for in-store pickup, you must present a valid government-issued photo ID and the physical credit/debit card used for the transaction upon collection. We reserve the right to refuse handover if verification fails.
6. Consumer guarantees (Australian Consumer Law)
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
These rights apply in addition to any voluntary or manufacturer's warranty and are not limited by these Terms or by any time period stated for our change-of-mind returns policy.
7. Returns, refunds and warranty
Change of mind: Where eligible, we accept change-of-mind returns within 14 days of delivery or in-store purchase, provided the item is unused, in its original factory-sealed packaging, and accompanied by proof of purchase. We strictly do not accept change-of-mind returns for activated smart devices (e.g., drones, cameras) or wearable/hygiene items (e.g., smart glasses, earphones) once the seal is broken. Return shipping for change-of-mind returns is at your cost.
Faulty or not as described: If a product is faulty, not as described, or fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund under the Australian Consumer Law. Please contact us with details and photos so we can assist.
Manufacturer warranties: Many products (such as DJI, XGIMI and other brands we carry) are covered by manufacturer warranties. We will help you make a claim where applicable, but warranty terms are set by the manufacturer.
To start a return or warranty claim, contact service@silktechs.com. Approved refunds are issued to your original payment method.
8. Silk Credit membership
Our Silk Credit loyalty program is offered subject to its own program terms, which form part of these Terms. Points and benefits have no cash value, are non-transferable, and may expire or be adjusted in accordance with the program terms. We reserve the right to modify or discontinue the program, or to suspend or cancel a membership in cases of fraud or abuse, on reasonable notice.
9. Promotions, discounts and gift cards
Promotional codes, discounts and gift cards are subject to their specific terms, cannot be exchanged for cash (except as required by law), and may be withdrawn or amended at any time. Only one promotional code may be used per order unless stated otherwise. We reserve the right to cancel orders made using fraudulently obtained or misused codes.
10. Intellectual property
All content on our website — including the SilkGear name, logo, "Stay Selective" slogan, text, graphics, images, and layout — is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, modify or distribute any content without our prior written permission. Product brand names and trademarks belong to their respective owners.
11. Acceptable use
You agree to use our website lawfully and not to: interfere with or disrupt the website or its security; use it for fraudulent or unlawful purposes; attempt to gain unauthorised access to our systems; or scrape, harvest or misuse data from the site. We may suspend or terminate your access if you breach these Terms.
12. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to those rights, to the maximum extent permitted by law, our total liability to you arising from your use of the website or the purchase of products is limited, at our option, to the resupply of the relevant products or the cost of resupplying them. We are not liable for any indirect, incidental or consequential loss.
13. Third-party links and showrooming
Our website and in-store experience may include links or QR codes that direct you to third-party brand partners (for example, under our Retail-as-a-Service arrangements). We are not responsible for the content, products, privacy practices or terms of those third-party sites, and your dealings with them are at your own risk.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. Please review it at [www.silkgear.com.au]/privacy.
15. Changes to these Terms
We may update these Terms from time to time. The version published on our website at the time you place an order applies to that order. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
